There are always going to be mistakes in physical gaming. A mistake does not mean a player is cheating, although the internet is fond of labeling every misplay "cheating" which confuses the discussion.
The difference between a mistake and cheating is intent. Specifically, the player knows they are breaking the rules.
This can be opportunistic - I accidentally drew extra cards, and then keep them instead of pointing out my mistake. The difference between this and a mistake is the player is aware of the error, but does not correct it. When that happens, it should be punished the same as planned cheating.
